In 2009, 52% of the voting population in California endorsed Proposition 8 which ratified the constitutional protection of marriage as between a man and a woman. One might argue that even 52% was shockingly low on something so important, but the people won that battle despite the veritable war of the homosexual militants to sink that Proposition.

Indeed, the proliferation of religious vilification laws, hate crimes legislation, and so on, is guaranteeing that the public proclamation of Christian truth claims will increasingly be stamped out. Whether the believer seeks to proclaim moral, social or theological truths, to do so in public is to risk facing the heavy hand of the law.

Judge Walker's decision is sweeping and comprehensive, basically affirming every argument and claim put forth by those demanding that California's Proposition 8 be declared unconstitutional. That proposition, affirmed by a clear majority of California voters, amended the state's constitution to define marriage as the union of a man and a woman.

Note the difference. Ken Howell did not insist that students believe or affirm the reasoned Catholic arguments against the moral legitimacy of homosexual acts. Rather, he required students who had chosen to taken an elective course on Catholicism to know and engage those arguments.
