The motion previously filed by TECSC asked for the dismissal of the case, primarily on the basis that it had not been filed in a timely fashion and that they were not actually taking ownership of the churches but merely exercising their trust interest in the property. The Diocese maintained that the court needed to decide which, if any, of the 29 parishes agreed (acceded) to the Dennis Canon before it could decide whether this case should proceed.

Friday evening, July 12, 2019, the historic vote happened and though the overall vote was overwhelmingly for the change, because it was to be a Canonical change it required a 2/3 majority in all three houses: Laity, Clergy and Bishops.

The outcome was the motion was defeated by the narrowest of margins because, although the laity and clergy houses both had votes far exceeding the 66.6 % vote required, the House of Bishops only had just over 62% which meant the motion was defeated.

I have come to this decision for many reasons both theological and practical. Of course, you may use the BCP 2019 (or other resources) in your private devotion but it is not to be used for liturgy at Mass, public Daily Offices or in any other way in the life of this church.

July 02 2019 By virtueonline South Carolina Supreme Court Allows Parishes and Diocese to Intervene and Denies Writ of Mandamus Petition by The Episcopal Church

At its core, the Petition was an attempt to end run Judge Dickson's exercise of his discretion in interpreting the August 2, 2017 decision in a manner that may differ from TEC's interpretation. However, the Supreme Court refused to tell Judge Dickson how he should rule in interpreting the August 2 decision. Instead the Court expressed confidence that Judge Dickson would "resolve the matters that are pending, in an expeditious manner."
